witness testfifes in house breaking case

 A CIVIL SERVANT from the office of the president has testified in the Livingstone Magistrate court how he discovered that his house was broken into and the thieves went away with his LG plasma Television and other assorted household goods.

Testifying, Mr Isaac Chikalipa, 51 of 2401 Nottie broad off Kafue road in Livingstone told the court that on the material date he had gone worship at the Seventh Day Adventist (SDA) central church in Livingstone, and before leaving he secured the house by locking.

“After 12 15 hours the church service ended, and we started going back home. When we reached home we found that the gate was still secured but when we went into the house we discovered that things had been scattered,” Mr Chikalipa said.

This is in a case in which a juvenile, appeared on Monday before Livingstone Resident magistrate Chinkashi Chilingala was charged with one count of house breaking and theft contrary to section 301(a) 272 of the Penal Code Chapter 87 of the Laws of Zambia.

“We found that the gate was locked, the sitting window was open, I then realised that something is wrong we also saw that wire fence was cut. I told my son to open the gate then on the window we discovered that the burglar bar was forced inside,” Mr Chikalipa said.

“We unlocked the house in the kitchen things were intact but the door to the dining room was damaged and in the sitting room things were not in order,” he said.

 Mr Chikalipa said when they checked they discovered that the Nokia, Samsung, Zamtel phones, a mattress, double bed sheet, LG 42 inch TV plasma screen all valued at about K12, 000.

He said the matter was reported the Livingstone central police station and the same day police officer later went to check on what had happened at the house.

Mr Chikalipa said on Monday he was told to go to the police station and identify the goods that had been recovered if they was any goods that belonged to him.

“I went to the police station, and after that I went with the police officers to my house with suspects where they demonstrate how they broke into the house and stole my property in the house,” he said.     

It is alleged that on May third this year the two jointly and whilst acting together with others broke and entered the dwelling house of Mr Chikalipa with intent to steal.


The juvenile stole one LG TV plasma, blanket duvet altogether valued at K12, 000.00 property of the Chikalipa.
