jailed for having stolen property

A 19 YEAR BOY has
been sent to jail for nine months by the Livingstone magistrate court for being
found in possession of property believed to have been stolen or unlawfully
obtained.
Appearing on Friday
before Livingstone Resident magistrate Chinkashi Chilingala was Justine Kabali, unemployed
of house number 792 of DSV extension Dambwa site and service in Livingstone.
He was facing one
count of being found in possession of property believed to have been stolen or
unlawfully obtained contrary to section 319 of chapter 87 of the penal code of
the laws of Zambia.
In mitigation,
Kabaili said he was a school going pupil at hillcrest secondary school and that
he had abdominal pains.
“I am a pupil at Hillcrest secondary school and if am sent
to prison my future will be affected, I also have abdominal pains. I am asking
for leniency from the court,” he said.
Mr Chilingala dismissed the mitigation of abdominal pains as
it was not indicated on the indictment that he had such pains and he had not
complained before the court.
“The offence you have committed is a very serious one so I
am sending you to prison for nine with hard labour so that you can reflect,” he
said.
It is alleged that on May 8 this year in Livingstone he had
in his possession one HP laptop one Del laptop one black bag which were
believed to have been stolen or unlawfully obtained.
And in the same court
Romoeo Khumalo, 38, unemployed of house number Sizinda Bulawayo has been jailed
for 12 months with hard labour for theft which is contrary to section 272 of
chapter 87 of the penal code of the laws of Zambia.
Mitigations, he said when he decided to travel back to his
country from a refugee camp, his belongs were stolen he thought if he stole
shoes he would find transport money back to his home country.
Magistrate Chilingala send him to prison for one year with
hard labour.
It is alleged that on May 7 this year in Livingstone he
stole two pairs of slippers altogether valued at K69.80 the property of Pep
stores in Livingstone.
And in another case before Mr Chilingala was Arthur Waluka
unemployed of house number 125 Maramba compound in Livingstone, who was facing one count house breaking house
contrary section to section 301 (a) and 272 of chapter 87 of the penal code of
the laws Of Zambia.
Mr Chilingala convicted and jailed him for
three years imprisonment with hard labour.
In
mitigation Waluka simply said he was sorry and was asking for forgiveness for
the crimes he had committed.
It is
alleged on May 4th this year in Livingstone, he did break and enter
into dwelling house of Lucky Mizinga with intent to steal from therein and did
steal from therein one Samsung Ipad one ladies coat valued at K4, 000 property
of Mizinga.
