mechanics in jail for burglary and theft

A 31 year old Livingstone mechanics
has been sentenced to two years and six months imprisonment with hard labour for
burglary and theft by the Livingstone magistrate court.
Appearing on Monday before
Livingstone Resident Magistrate Chinkashi Chilingala was Bonaventure Sitali of
house number D 8 Kashitue in Livingstone.
Mr Sitaili is facing one count of
burglary and theft contrary to section 301 (a) and 272 of the penal code
chapter 87 of the laws of Zambia.
In mitigation Siatali told the
court that he was the sole bread winner of the family as he was looking after
his siblings as both of his parents were dead.
“My parents are dead and I am the
one who looks after my young brothers and sisters, it is for this reason that I
am asking for forgiveness from the court,” he said.
In sentencing him, Mr Chilingala
said he had considered his mitigation as well as that he was a first offender
but the court had a duty to protect the citizens in the country from people
like him.
“The cases of burglary and theft are
becoming rampant in Livingstone. It is the duty of the court to ensure that the
increase is put in check. We shall be failing in our duty if we do not eliminate
people like you from society as you are a danger. It is our duty to protect the
citizens as such I am left with no option but to give you a custodial
sentence,” he said.
He said the offence that
Sitali had committed was a serious one as the legislator felt that people like
Sitali that commit such offences should go to prison for 10 years.
“The legislator felt that the people
like you should go to prison for 10 years as this offence is a serious one, so
I am sending you to prison for two years six months, you have right to appeal
my sentence within 14 days to the high court if you are not happy with my
sentence,” he said.
It is alleged in the night of March
18 this year in Livingstone, Sitali did break and enter the
dwelling housed of Nora Sikaneta with intent to steal from there in and he
stole one purse, three skin jeans, three hipsters, six curtains and
K750 cash altogether valued at K1,370.00 the property of Sikaneta.
