A 20 YEAR OLD Livingstone taxi driver has been sentenced by Livingstone
magistrate court to nine years imprisonment with had labour for stealing from his
customer that had booked the taxi from a named night club.
This is in a case in which Shammy Mudenda, of house number G 192
Maramba Township is charged with robbery.
It is alleged that on July 22, this year, Mudenda robbed
Veronica Burditt Chisi off two cell phone, purse, national registration card,
four ATM cards and cash money K800 altogether valued at K2, 400.
At or immediately before or immediately after such robbery did or threatened to use actual violence to the said
Chisi in order to overcome resistance to the property being stolen.
In his judgment, Livingstone Chief Resident magistrate Willie
Sinyangwe said he had carefully considered the evidence that the prosecution
had brought before his court.
Magistrate Sinyangwe said the prosecution had proved that the
accused had indeed committed the offence.
“It is not in dispute that the phones were found in the accused
person’s possession and the victim was assaulted by the convict,” he said.
He said the court has also taken into account of the mitigation by
the convict.
The Chief Resident magistrate said it is the duty of the court to
ensure that bad elements like him are removed from society as he is a danger.
“The offence that you have committed is very serious, I will sentence you to nine years imprisonment
with hard labour, and if you are not happy with both the conviction and sentence
you have right to appeal within fourteen days,” he said.
In mitigation Mudenda said he was asking for maximum leniency
from the court.
He said that he did not know what he doing when he committed the
offence.
