A witness has told the Livingstone Magistrate Court sitting in Kazungula as a mobile court in a preliminary inquire on an aggravated robbery case that he could not tell whether at the time of the crime, he was in Democratic Republic of Congo.   

An employ of inter link Africa Harold Chaima of Kazungula told the court that he could not confirm that the accused person was in DRC.

Speaking during cross examination by Major (RTD) Isaac Masonga from KBF and partners, who asked the witness on whether it was possible to sneak into a foreign country and committing a crime.

In response Mr Chaima said he had heard that some were able to sneak out of any country and commit a crime.

“I have proof to show that this is the man that was here (at the scene of the crime), it is very possible for people to sneak into the country and commit a crime,” Mr Chaima.

KBF partners asked the witness why he was using information was from his girlfriend an immigration officer to increment their client.

 Mr Chaima admitted having a girlfriend an immigration officer but however denied using her to get information to increment the accused person.

“I have a lot of girlfriends, and I also have a girlfriend an immigration officer at Kazungula border post and it is not true that I used her to get information about the accused person to get the accused person’s photo printed out,” he said.

This is in a case before Livingstone Magistrate Naomi Sithole was Qubekani Dube, 47, a Zimbabwean truck driver based in South Africa  of Unit 166 Grassland estate Boksburg North Gemstone South Africa, of NRC no. 53-025999E53.

Dube is charged with aggravated robbery contrary to the section 294(1) of the penal code of the laws of Zambia.

It is alleged that, on 31st December in Kazungula, Dube being armed with offensive weapons namely a pistol, jointly and whilst acting together with another three unknown.

He did rob Harold Chaima off US$17,935.00 cash equivalent to 89,675.00 and K15911.00.00 cash altogether valued at 105,586.00.

At or immediately before or immediately after such robbery did or threatened to use actual violence to the said Chaima in order to overcome resistance to the property being stolen.

The matter has been adjourned to the June 11 this year for continued cross examination.
