DJ in trouble for corruption

Anti-Corruption Commission (ACC) senior corruption prevention officer told the Livingstone magistrate court yesterday, how he told the complainant that the accused person had committed an offence according to the ACC act.

This is in a case, before Livingstone Resident Magistrate Chinkashi Chilingala was Zambezi FM radio Disc Jockey and Journalist Danny Anakene, 39, of House Number DNB 111, Dambwa North in Livingstone.

Testifying in the matter ACC senior corruption prevention officer Kevin Siwale, 34 of Simatobolo road Nottie Broad in Livingstone, he told the court that he advised Livingstone Town Clerk Vivian Chiwila Chikoti whilst he was attending a meeting at Armadilo restaurant in that the accused person committed an offence according to the ACC act.

 Mr Siwale said Ms Chikoti had shown him five messages whilst the restaurant and he then suggested that they should met at his office or her office so that they could discuss the matter further as they are a lot of people at the restaurant.

 He said the conversation between the two there was no miscommunication as Anakane wanted to be offered a plot by offering K4 million then.

“Dan wanted to be offered a plot as the offer related to the plots by the Livingstone city council was an interview is K300,000 and interview fee is K 20,000 as it is was not K2 million or K 4 million that he was offering,” he said.

“I feel that the amount he offered may not be related to the interview fees or services charge for a plot as the service charge can only be charged if the person has been offered a plot and has an offer letter and not before,” he said.

Mr Siwale said this was not the case in the accused person’s situation and that the apology to an offence does not have any affect as the offence has already been committed according to the ACC act and it cannot be taken into account.

 He said Ms Chikoti was very upset with Anakene for the text messages that he had sent to the town clerk and Anakene then sent a message of apology but still insisting the he wanted to be offered a plot.

 Mr Siwale said he made a request to have the matter to be investigated and later the authority was granted and investigations commenced in the matter.

“I asked the town clerk to forward all the messages to me, and around 19 hours she did so I read through the messages and they were exactly as I had read them whilst in her office,” he said.

Mr Siwale said text message were to the town clerk’s number 0977879819 and they coming from and Anakene’s phone 0977846906 and the town clerk forwarded to his in which is 0979606598.

 

 Mr Anakene is facing one count of corrupt practices with a public officer contrary to section 19 (2) as read with section 66 of the Anti-Corruption Act number 3 of 2012 of the Laws of Zambia.

Particulars of the offence allege that on a date unknown but between 1st November, 2012 and 31st December, 2012 in Livingstone.

Mr. Anakene corruptly offered K 4, 000 to Vivian Chiwila Chikoti, a public officer with the Livingstone city council as Town Clerk as an inducement for the said Chikoti to allocate him a piece of Land in Livingstone, a matter or transaction that concerns Livingstone City Council, a public body.

“You police bond has been extend and your trial will continue July 14 this this year, you may stand down,” Magistrate Chilingala said.

The state is being represented by Cliff Moongo and Boniface Chiwala and the defense is by Solomon Muzyamba.
