A 41 year old of Dambwa site and service has sentenced to five months imprisonment with hard labour for stealing a tool box.
This is in a case which Sidney Kakoma is charged with theft.
It is alleged that on unknown dates but between august 22 and 24 this year in Livingstone, he stole a tool box valued at K 1,500, the property of Simon Zulu.
And facts of the case are that on August 22 this year Zulu secured his tool box after knocking off from the place where he operates from near jungle Restaurant.
On August 24 when he reported for work he discovered that the tool box was missing and when he asked around he was told that the accused person was seen leaving with the tool box.
The matter was reported to the police and the property was recovered in its full value.
In mitigation Kakoma told the court that he was asking forgiveness because he has realized that he was wrong.
“I made a mistake by stealing the tool box, you the court, you are my father and mother and I am therefore at your mercy for leniency,” he said.
And in sentencing Livingstone magistrate Michael Mulalelo said the court has heard what the convict has said in his mitigation.
“I have considered what you have said in your mitigation and that you have admitted the charge without wasting the court’s time,” he said.
He said sad that convict is a person that is fit and able bodied and it is unacceptable that he should resort to stealing.
“I will send you to prison for 5 months imprisonment with hard labour so that you can reflect on your actions and your right is here by granted for you to appeal to the high court within fourteen days,” he said.
