A 44 year old drug trafficker Patrick Moongwa has been sentenced to nine months imprisonment with hard labour for trafficking in 30.6 grammes of marijuana by the Livingstone magistrate court.

A 44 year old drug trafficker
Patrick Moongwa has been sentenced to nine months imprisonment with hard labour
for trafficking in 30.6 grammes of marijuana by the Livingstone magistrate
court.
This is in a case in which the
convict was charged with trafficking in marijuana contrary to the laws of
Zambia.
It is alleged that on September 2
this year in Livingstone, Moongwa trafficked in marijuana without lawful
authority.
Drug Enforcement Commission (DEC)
prosecutor Andrew Pikiti told the court in the facts of the case that his
officers received information that there was a male person in Mbita compound
dealing in psychotropic substances.
Mr Pikiti said the officers rushed
to the area and found the now convict, during body search he found with 10
balls of marijuana.
He said the suspect marijuana was
sent to UTH where a public analyst proved that the Marijuana was a herbal
product of cannabis Sativa.
He said convict had no right to be
in possession of marijuana.
And Mr Pikiti told the court that
the accused was a first offender.
But Moongwa told the court that he
was not a first offender adding that he was once convicted for nine months and
he only served six months.
He failed to tell the court at which
prison he was serving his sentence of being in possession of 2.2 grammes.
“The marijuana that was found in my
possession was for selling and I was with my friend but he run away,” he said.
This prompted Livingstone magistrate Benjamin
Mwelwa why they did not have any records of the convict being a second offender
by his confession in court.
And Mr Pikiti insisted that
there was no record to prove that he was second offender and he should treated
as such.
And in mitigation, Moongwa told the
court that he was at the mercy of the court and that it was up to the court to
decide his fate.
He said he was only asking the court
to forgive for the offence that he had committed.
In judgment, Magistrate Mwelwa said
the court would consider his mitigation that he would treat him as a first
offender.
“I will send you to prison for nine
months imprisonment with hard labour so that you can reflect on your actions.
I will grant you leave to appeal to
the High Court within fourteen days if you are not satisfied with my sentence,”
he said.
