assault lands man 12 months

A 21 year old man of Zambezi sawmills compound in Livingstone has been sentenced to 12 months imprisonment with hard labour for assaulting a person again.
Appearing on Thursday before Livingstone magistrate Benjamin Mwewa was Chinyemba Mandandi of house number 210 Zambezi sawmills compound in Livingstone.
Manandi who is second offender in assault was facing one count of assault which is contrary to section 248 of the penal code chapter 87 of the laws of Zambia.
In mitigation Mandandi asked the court to be lenient on him as he was a bread winner.
However, in sentencing him Magistrate Mwewa said he had considered what the convict had said in his mitigation nevertheless in view of the fact that Mandandi was a second offender in the case of assault the court was left with no choice but to send him to prison.
“The court has a duty to ensure that people like you are removed from society as you are danger, I will send to prison for 12 months as this is enough time for you to reflect, your sentence will be effective from the date of your arrest,” he said.
He reminded him that he had the right to appeal against his conviction within fourteen day to the high court.
The particulars of the offence are that on August five this year, Mandandi assaulted Stanely Mazunda thereby occasioning him actual bodily harm.
